Hippocrates & Tarasoff Walk Into a Bar: Confidentiality, Privilege & Duty

The California Supreme Court's decision in the Tarasoff case over 30 years ago has influenced the legal requirements governing therapists' duty to protect third parties in nearly every state in the country. The Tarasoff decision ultimately created a legal duty of protect which overrode the confidentiality of the therapist-patient relationship. This lecture will cover basic, but important psychiatric legal concepts including distinctions between confidentiality and privilege. The history of the famous Tarasoff case will be discussed, as well as the legal requirements in NY State set forth in Mental Hygiene Law, section 33.12. Recommendations based on recent literature will be discussed regarding how the mental health professional might best respond when a duty to proect scenario arises in clinical practice. Finally, the audience will be invited to discuss a Tarasoff scenario presented via video vignette.
